Terms of Service

1. Acceptance of terms

By accessing or using the ShoppingScraper platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. The Service is provided by ShoppingResult, registered in the Netherlands (Smederijstraat 2, 4814 DB Breda).

2. Definitions

  • “Account” -- your registered user account on the Service.
  • “API” -- the ShoppingScraper application programming interface.
  • “Credits” -- the metered units used to measure API usage within your plan.
  • “Content” -- any data, text, images, or other materials you submit or retrieve through the Service.

3. Account registration

You must provide accurate and complete information when creating an Account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your Account. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Permitted use

You agree to use the Service only for lawful purposes. You may not:

  • Resell, redistribute, or sublicense raw API output to third parties without our written consent.
  • Use the Service to scrape data in violation of applicable laws or the terms of the scraped websites.
  • Attempt to circumvent rate limits, authentication, or security measures.
  • Interfere with or disrupt the Service or its underlying infrastructure.
  • Use the Service to collect personal data of individuals without a lawful basis.

5. Plans, credits, and billing

The Service offers several subscription plans with a fixed monthly credit allowance. Unused credits do not roll over. Prices are listed in EUR and exclude VAT where applicable. Payments are processed by Stripe.

We may change pricing with at least 30 days written notice. Continued use after the change constitutes acceptance of the new pricing.

6. Free trial

New accounts receive a one-time allocation of free credits. The free trial does not require payment information. Once the free credits are used, you must subscribe to a paid plan to continue using the Service.

7. Cancellation and refunds

You may cancel your subscription at any time from the dashboard. Your access continues until the end of the current billing period. Refunds are not provided for partial billing periods.

We reserve the right to suspend or terminate your Account if you violate these Terms, with or without notice.

8. Intellectual property

All rights, title, and interest in the Service, including its software, branding, and documentation, belong to ShoppingResult. You are granted a limited, non-exclusive, revocable licence to use the Service in accordance with these Terms.

Data retrieved via the API is sourced from publicly available information. You are responsible for ensuring your use of this data complies with applicable laws and the terms of the source websites.

ShoppingScraper is an independent service. We are not affiliated with, endorsed by, or connected to any retailer, marketplace, or brand whose data is accessible through the Service. All product names, logos, and trademarks are the property of their respective owners.

9. Data and privacy

Our processing of personal data is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

10. Availability and SLA

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance is announced at least 48 hours in advance. Enterprise customers may negotiate a separate SLA.

11. Limitation of liability

To the maximum extent permitted by law, ShoppingResult shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of warranties

The Service is provided “as is” and “as available”. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of data retrieved via the API.

13. Indemnification

You agree to indemnify and hold harmless ShoppingResult, its employees, and affiliates from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

14. Changes to these terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the Service at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Breda, the Netherlands.
